THE IMAGE DATA The image files on this CD-ROM are in band sequential format (BSQ). Each band of imagery is contained in a separate file. There are no header bytes in the image files. Image dimensions can be found both in the CD-ROM labels and within the HEADER.DAT file. Space Imaging is the owner of the Satellite Data or is licensed by the owner of the Satellite Data to sell the Satellite Data. For sales where Space Imaging sells Satellite Data as a licensee, the term Space Imaging shall be deemed to include such owner and the following restrictions shall bind User with respect to such owner; and shall also be enforceable by Space Imaging on its own behalf and, at Space Imaging's option, on behalf of the owner of the Satellite Data. CONFIDENTIALITY OF SATELLITE DATA. User acknowledges that Satellite Data is a special, valuable and unique asset of Space Imaging, and is confidential information which is disclosed in confidence to User under a separate Agreement for Purchase and Confidential Treatment of Satellite Data ("Confidentiality Agreement"). With respect to such disclosure: a. User agrees to use, translate, enhance or display the Satellite Data disclosed herein only for authorized use as defined in the Confidentiality Agreement, and in no event for any publication or distribution of the Satellite Data in unenhanced form. b. User agrees not to reproduce or permit reproduction of Satellite Data. Enhancement of Satellite Data shall not be considered reproduction. c. User agrees not to permit access to, disclose or otherwise make available any Satellite Data to any person for any purpose, except to employees, affiliates, contractors and consultants of and designated by the Purchaser of the Satellite Data as defined in the Confidentiality Agreement. d. Without limiting the generality of the foregoing, User agrees to abide by the limitations on the package warning and not to separate the package warning from the Satellite Data except as may be necessary to use the Satellite Data as contemplated hereby. A copy of Space Imaging's Package Warning appears below. LIMITED WARRANTY. Unless otherwise indicated in a statement accompanying Satellite Data delivered hereunder, Space Imaging warrants that the Satellite Data it provides will cover the area of the Earth and spectral bands specified in User's order, and will be radiometrically or geometrically corrected if requested in User's order. In addition, Space Imaging warrants that the media used to carry the data shall be free from defects in materials and workmanship under normal use for 90 days from the date of delivery to Users in U.S.A. and 120 days to international customers. THE FOREGOING WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. LIMITATION OF REMEDIES. If the Satellite Data is not as warranted by Space Imaging herein, upon return of such data, Space Imaging shall replace the Satellite Data or refund the purchase price therefore, at Space Imaging's option. Such replacement or refund shall be the User's exclusive remedy for any delivery or non-delivery of Satellite Data. SPACE IMAGING'S LIABILITY FOR DAMAGES TO THE USER FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT OR IN TORT AND WHETHER OR NOT SPACE IMAGING WAS NEGLIGENT, ACTIVELY OR PASSIVELY, SHALL IN NO EVENT EXCEED THE PURCHASE PRICE PAID BY THE USER FOR THE DEFECTIVE SATELLITE DATA. In no event will SPACE IMAGING be liable for any lost profits, lost savings or other consequential damages, even if SPACE IMAGING has been advised of the possibility of such damages. Any product that is returned for credit or replacement after the product warranty expires will incur a reprocessing charge equal to 20% of the returned product's current list price. For each product being returned for credit or replacement, provide as much information as possible, including the reverse-side "CUSTOMER ASSESSMENT OF RETURNED PRODUCT" form and enclose with the product(s).
